The Yitzhak Rabin Center for Israel Studies (the “Center”) welcomes users to its website (the “Website”). The Website is managed and operated by the Center and provides its users with a wide range of services, including the ability to review materials from the Center’s archives, the provision of educational material for public review, and the possibility to order admission tickets to the Center’s facilities, and for various events and activities held at the Center and its facilities (including the Center’s museum, commemoration activities, museum activities, education and advocacy activities, changing exhibitions, cultural activities, plays, etc.) (the “Tickets”, the “Center Facilities”, and the “Activities”, respectively).
1. General
1.1. Browsing the Website and performing actions therein are subject to the terms detailed in these Regulations. Please read the Regulations carefully, as browsing the Website and performing actions therein indicate your consent to the terms included in these Regulations and Terms of Use.
1.2. These terms apply to the use of the Website and the content included therein via any computer or other communication device (such as a cellular phone, various tablet computers, etc.). They also apply to the use of the Website, whether via the internet or via any other network or means of communication.
1.3. The provisions of these Regulations and Terms of Use refer equally to both genders, and the use of the masculine gender is for convenience only.
1.4. Placing an order for Tickets on the Website (as described below) shall be permitted to persons with legal capacity over the age of 18 only. A minor under the age of 18 who wishes to place an order for Tickets on the Website is required to obtain the consent of a parent or guardian.
1.5. The Tickets offered for order on the Website are offered by the Center and/or entities with which the Center cooperates.
1.6. Website users are requested to read all details regarding the Tickets offered for order on the Website to ensure their suitability to their needs and requirements. It is clarified for the avoidance of doubt that the Center shall have no liability in the event of non-suitability, for any reason whatsoever.
1.7. The Center reserves the right to update these Regulations and Terms of Use from time to time, at its sole discretion and without the need to provide any notice. The validity of such change shall commence from the moment of its publication on the Website.
2. Browsing the Website
2.1. Browsing and reviewing the Website do not require registration and are open to all users.
2.2. Website users may join the Center’s mailing list and enjoy receiving direct mailing from the Center (marketing mail) which includes, inter alia, receiving the Center’s newsletter, receiving information regarding Activities held at the Center and its facilities, receiving educational material, etc. (the “Mailing List” and the “Center Publications”, respectively).
2.3. Joining the Mailing List as aforesaid constitutes consent by the users to the sending of “advertisements” in accordance with the provisions of the Communications Law (Telecommunications and Broadcasting) (Amendment No. 40), 5768-2008 (the “Communications Law”).
2.4. It is clarified that any user registered to the Mailing List may remove themselves from it at any time by contacting the Center via email at: info@rabincenter.org.il, or by replying to the email from which the Center Publications were sent. As long as the user has not removed themselves from the Mailing List as aforesaid, the Center may, subject to the Communications Law, transmit direct mailing and Center Publications to the user as stated.
2.5. The Center may prevent any user from using the Website and/or cancel their registration in the Website’s Mailing List at its absolute discretion. Without derogating from the above, the Center may cancel the registration of any of the Website users in the Mailing List, or block their access to the Website, in any of the following cases:
- In the event that the Website was used to perform or attempt to perform an illegal act under the laws of the State of Israel, or an act that appears on its face to be illegal as aforesaid, or to enable, facilitate, assist, or encourage the performance of such an act;
- If these Terms of Use have been violated.
3. Tickets Offered for Order on the Website
3.1. The Tickets offered for order on the Website are admission tickets to the Center’s facilities and for Activities taking place at the Center and its facilities, as they may be from time to time.
3.2. The manner in which Activities are presented on the Website is at the sole discretion of the Center. It is clarified that in addition to the provisions of these Regulations and general terms, all images displayed on the Website are for illustrative purposes only.
3.3. All photographs and/or diagrams of the Center’s facilities that appear on the Website, to the extent they appear, are intended for illustrative purposes only and shall not be binding upon the Center. It is explicitly clarified that there may be changes and/or inaccuracies originating from production needs beyond the Center’s control and/or graphics problems, technical issues, use of computer monitors with different resolutions, use of different software, etc. Such photographs and/or diagrams of the Center’s facilities do not and shall not constitute a representation by the Center prior to the ordering and purchase of Tickets, and the Center is not and shall not be responsible for errors of any kind that appear on the Website, including textual errors and/or errors in the description of one facility or another.
3.4. Unless otherwise stated, ordering Tickets on the Website does not include a promise by the Center for a marked or reserved seat. In this regard, it is clarified that the seating arrangement in Activities held by the Center and in its facilities is on a “first-come, first-served” basis and based on the available space in the hall at that moment, as applicable.
3.5. In the event of a contradiction between the provisions on the Website and the provisions in any other publication regarding the Activities, or any of them, the later provision shall always prevail, provided that the later provision was published by the Center or someone on its behalf, including the producers and/or organizers of the Activity to which the publication relates.
4. Placing an Order on the Website and Collection of Orders
4.1. Ordering Tickets on the Website does not require registration to the Website and is possible for all users. Notwithstanding the above, when placing an order on the Website, the purchaser will be requested to provide personal details such as: first name, last name, ID number, telephone, residential address, date of birth, and an active email address. Providing partial or incorrect details may prevent the possibility of making purchases and orders on the Website and frustrate contact if necessary.
4.2. The data provided during the placement of an order on the Website as stated in Section 4.1 above, as well as details regarding the type of credit card used for the order, the expiry date of the credit card, and the last four digits of said credit card, shall be stored in the database owned by the Center. It is clarified that there is no legal obligation to provide the aforementioned data, however, without providing it, an order cannot be placed on the Website.
4.3. The Center shall not make use of the details provided except in accordance with the Website’s Privacy Policy, which constitutes an integral part of these Regulations and Terms of Use.
4.4. When placing an order on the Website, the purchaser will be given the option to agree to and confirm their joining of the Center’s Mailing List and the receipt of Center Publications sent on its behalf, and the provisions of Sections 2.3 and 2.4 above shall apply to them.
4.5. Payment for the Ticket order shall be made via a credit card belonging to the purchaser, whose identification details match the data provided to the Center at the time of purchase and order.
4.6. Notwithstanding the above, the Center reserves the right to determine other payment arrangements for purchasers, all at its sole discretion.
4.7. Ordering Tickets via the Website is intended for personal use only and not for commercial uses; therefore, the Center shall be entitled, but not obligated, to limit the quantity of Tickets that may be purchased and ordered with one credit card and/or in any single entry to the Website, where such limitation shall be at the sole discretion of the Center.
4.8. The Center reserves the right not to honor and/or to cancel an order within up to 48 hours from the time of its placement if, in its opinion and at its sole discretion, the order was placed in violation of these Regulations and Terms of Use, as they may be from time to time, and/or by mistake and/or while attempting to circumvent any provision of these Regulations and Terms of Use, without the purchaser having any claim and/or demand and/or suit in connection therewith. Any decision regarding cancellation shall be delivered to the purchaser using the details provided at the time of placing the order.
4.9. Preconditions for ordering Tickets are as follows: 4.9.1. Completion of the verification check of the identification details as well as the credit card details and validity provided by the purchaser; 4.9.2. Receipt of approval from the credit card company for the transaction. Notice of the receipt and approval of the order by the Center shall be sent via an email message to the email address provided by the purchaser during the purchase and ordering process, within 2 business days from the time of placing the order (the “Order Confirmation”). An order that has not been confirmed by a return email from the Center as stated above shall not bind the Center, and the purchaser must contact the Center’s orders department by telephone immediately at: *9515 (the “Orders Department”).
4.10. In order for the Center to provide the Order Confirmation as stated above, the order placed by the purchaser must be received and recorded on the Website in a proper and orderly manner, containing all details required for the order and for charging the purchaser. Various reasons may cause malfunctions and disruptions in the recording of the order. Should the purchaser receive a notice during the placement of the order and/or after the placement of the order regarding incorrect content in the order details and/or a notice regarding a malfunction that occurred in the system during the recording of the order, the purchaser must contact the Orders Department.
4.11. Every purchaser who has purchased a ticket shall be entitled to collect their ticket in the manner described in Section 4.15 below. After presenting the ticket at the designated place in the Center and/or its facilities, the ticket holder shall be entitled to enter the Center facilities specified on the ticket and/or watch and participate in the Activity (as applicable). This right of the purchaser as aforesaid is subject to the provisions of these Regulations and Terms of Use, as well as the instructions appearing at the site of the Activity, in the Center facilities, and on the tickets. The purchaser must check, prior to the day of arrival at the Center facilities, the restrictions applying both in these Regulations and Terms of Use and on the ticket itself. The Center shall bear no liability for a prohibition of which the purchaser became aware only upon arrival at the Center facilities or upon receiving the ticket at the Center box office (as described below). Notwithstanding the above, it is clarified that entry to the Center’s museum is conducted in groups of up to 20 visitors, approximately every 15 minutes. Every purchaser buying a ticket for the Center’s museum shall choose in their order the date and time at which they intend to visit the Center’s museum, subject to the availability of visiting hours on the Website. The visit to the museum shall be in accordance with the date and time chosen by the purchaser only, and the Center shall not be obligated to admit a purchaser who arrived late and/or did not appear at said time, all in accordance with the provisions of Section 4.16 below.
4.12. Disabled persons and persons with disabilities whose entry to the Center facilities and/or seating methods and arrangements require prior coordination with the Center—such as in cases where accessible seating is required—are requested to contact the Orders Department upon completion of the order for coordination.
4.13. It is prohibited to bring food (in any form) or drinks in cans, plastic bottles, glass bottles, or any pressurized containers (aerosols) into the Center facilities, including the Center’s museum area, the main conference hall, and the classrooms operating in the Center. Furthermore, it is prohibited to bring weapons (firearms or cold weapons, including knives/pocketknives) into the Center’s museum and the Center’s conference hall, and there is no possibility to store them for safekeeping on-site. Additionally, entry to the Center and its facilities (including the museum and/or the Center’s conference hall) with bags and other large objects will not be permitted; the Center provides its visitors with cloakroom services through which visitors may deposit bags, coats, umbrellas, etc. (excluding the deposit of weapons of any kind, the deposit of which will not be permitted in any case as stated above), and the deposit of bags or other large objects is mandatory. In this regard, it is clarified that the Center is not responsible for any damage and/or loss of the objects deposited as aforesaid, and accordingly, visitors are advised not to deposit valuable items. It is prohibited to bring still and/or video cameras into the Center and its facilities, and it is strictly prohibited to photograph in the Center’s museum, except subject to receiving prior written approval from the Center, which is conditioned upon receiving a detailed explanation from the Center regarding permitted photography rules and a prior written undertaking by the applicant not to use the photographs in a manner that contradicts the Center’s policy and/or in a manner that infringes copyright, in accordance with a version to be approved by the Center.
4.14. The Center reserves the right to remove a spectator and/or visitor who disrupts public order and/or behaves violently, and in the event that the Center or anyone on its behalf exercises this right as aforesaid, the purchaser/spectator/visitor shall not be entitled to any financial refund and shall not have any claims or suits against the Center.
4.15. Tickets ordered through the Website shall be collected by the purchaser at the Center’s box office only. Collection of tickets will be possible on the day of the visit to the Center and/or its facilities, up to 30 minutes before the start of the Activity and/or before the time set in the Order Confirmation. Upon collecting the tickets, the purchaser will be requested to present the credit card through which the order was placed as well as an identifying document. For the avoidance of doubt—tickets purchased on the Website will not be delivered without the presentation of the Order Confirmation, the credit card with which the order was placed, and an official identifying document (ID card or driver’s license) bearing a photo, but this shall not cancel the order, and the purchaser will be charged for the full amount of the transaction.
4.16. In the event of closing the doors of the Activity after its commencement and/or in the event of lateness to a visit to the Center facilities relative to the ordered visiting hour, entry for latecomers is not guaranteed and no financial refund and/or compensation will be given for the ordered tickets.
5. Prices Presented on the Website
5.1. The price appearing on the Website in relation to each Activity is the current ticket price. The Center may from time to time update the price of the tickets offered for order on the Website, regardless of the time of placing an order on the Website, and without the need for notice thereof. Without derogating from the above, the Center reserves the right to charge a handling fee as well as a sales commission in an amount permitted to it by law.
5.2. The Center may offer members registered in the Center’s Mailing List various promotions and discounts regarding Center Activities. The Center may offer such promotions and discounts on the Website and change or terminate them at any time, all at its sole discretion.
6. Order Cancellation Policy
6.1. Any order of Tickets placed on the Website may be canceled within 14 days from the date of the transaction and no later than 7 business days prior to the Activity, all subject to the provisions of the Consumer Protection Law, 5741-1981 (the “Consumer Protection Law”), and the provisions of the Consumer Protection Regulations (Cancellation of a Transaction), 5771-2010 (the “Regulations”), as they may be from time to time.
6.2. At the time of cancellation of the order by the purchaser, the credit card with which the order was placed shall be credited for the amount of the order fee, and the Center reserves the right to deduct an amount equal to 5% of the transaction value, or NIS 100, whichever is lower, all subject to the provisions of the Consumer Protection Law and the Regulations, as they may be from time to time.
6.3. A request to change the date and/or time of a visit and/or performance by the purchaser shall be considered a request to cancel the original order and open a new order.
6.4. In the event of cancellation of an Activity, the purchaser shall be entitled to a full refund of the payment they made. A purchaser who has not yet collected the tickets shall be credited in their account via the credit card company through which the transaction was made only for the full amount of the transaction. If the Activity was postponed to a new date, or moved to another facility, or in the event of a change in the structure of the facility where the event is expected to take place (for example, a change in the space in the Center where the Activity will take place), then the ticket shall be valid for the new date and/or the new facility and/or the new structure of the facility, as applicable, and the purchaser shall be entitled to use it, or cancel their order within 7 days from the day the Center announced said change, or until the day of the performance, whichever is earlier, and receive a full refund from the Center.
7. The Center Archive
7.1. As part of the services provided to the community of Website users, the Center provides users with the possibility to review some of the documents, printed matter, photographs, recordings, data, videos, posters, and any other material found in the Center’s Archive, concerning the history, policy, society, culture, economy, and security of the State of Israel, emphasizing the vision, work, and legacy of Yitzhak Rabin (the “Materials” and the “Archive”, respectively).
7.2. Searching for Materials in the Archive shall be via an online search engine on the designated page of the Website, operated by the Center.
7.3. It is hereby clarified that the Materials found in the Archive are for review only, and the provisions of Section 11 below shall apply to them. Any use of the Materials found in the Archive in a manner that contradicts the provisions of this Section 7.3 shall be subject to receiving prior written approval from the Center.
8. The Center’s Liability
8.1. Every order of a ticket on the Website is made between the purchaser and the Center.
8.2. The Center’s liability for the Tickets offered for sale on the Website is limited to the amount of the ticket cost to the customer only.
8.3. The use of the Website shall be at the sole and full responsibility of each user and ticket purchaser.
8.4. The information appearing on the Website shall not be seen as a promise of any result and/or liability for the occurrence of any Activity. The Center shall not be liable for any damage, direct or indirect, caused to a user and/or purchaser as a result of reliance on information appearing on the Website and/or in links to other websites and/or any other internal and/or external information source and/or use of a ticket offered for sale therein.
8.5. Information and representations regarding tickets and Activities presented on the Website originate, inter alia, from entities with which the Center cooperates. Therefore, any content regarding Activities brought by said entities is under the sole responsibility of these entities, and the Center has and shall have no liability for such information, and the Center does not guarantee the degree of accuracy of this information.
8.6. It is clarified that in no case shall the Center and/or any entity related to it and/or its employees and/or anyone on its behalf bear any liability for direct and/or indirect damage, loss, mental anguish, punitive damages, incidental, special or consequential damage, and/or for any other damage or expense of any kind and type caused to users and/or any third parties, including, and without prejudice to the generality of the above, damages for loss of use, loss of data, or loss of profits, arising from or related in any way to the order, supply or non-supply of tickets, or any information, materials, software, product, service, and accompanying graphics obtained through the Website and the Archive and/or arising in any other way from the use of the Website and the Archive, whether based on an agreement or in tort, whether in strict liability, and/or any other cause, even if the Center was informed of the possibility of such damages.
8.7. It is hereby explicitly clarified that a ticket is treated as an unidentified banknote and therefore, the loss of a ticket and/or its destruction and/or any act or omission due to which it will not be possible to use the ticket that was ordered and delivered to the purchaser shall be under the sole responsibility of the purchaser, and it will not be possible to restore it and/or give the purchaser an alternative ticket, except in special cases.
8.8. The Center wishes to clarify that although it makes maximum efforts for the information on the Website to be as current and accurate as possible, the Website is not free from inaccuracies or errors. The use of the Website and the information appearing therein, in all its parts, including the Archive Materials [Note: defined above], and reliance on said information and materials, are therefore done at the users’ sole responsibility.
8.9. In no case shall the Center be liable for damage caused to Website users through contacting the entities with which the Center cooperates not by way of ordering tickets through the Website.
8.10. The presentation of information, data, materials, and images on the Website does not constitute an expression of opinion and/or an expert opinion and/or a recommendation regarding the Activity presented on the Website and/or regarding its program.
8.11. The Center recommends that purchasers and users of the Website act as wise and cautious consumers and carefully read the information presented on the Website, including information regarding the tickets, Activities, Center facilities, their description, and their suitability.
8.12. The Website as a whole, including all information, materials, and content appearing therein, is offered to the public and provided for use “AS IS,” and shall be as accurate and correct as possible. They cannot be adapted to the needs of each and every person. The user shall have no claim, suit, or demand against the Center and/or the entities with which the Center cooperates regarding the features of the content, their capabilities, their limitations, and/or their suitability to their needs. Furthermore, no claim of any user shall be heard regarding the quality of the materials found on the Website, including regarding the materials included in the Center’s Archive and available for review on the Center’s Website.
9. Use of the Website
9.1. One may not operate or allow the operation of any computer application or any other means, including software such as Robots, Crawlers, and the like, for searching, scanning, copying, or automatic retrieval of content from the Website. This includes not creating and not using such means for creating a compilation, collection, or database that will contain content from the Website.
9.2. Content from the Website may not be displayed in any way—including via any software, device, accessory, or communication protocol—that changes its design on the Website or omits any content, specifically advertisements and commercial content.
9.3. The Center shall not bear any liability for any damage caused as a result of any link to content from the Website and from any display or publication of such content in any other way. The full and exclusive responsibility for any link, display, or publication of the content rests solely with the person performing the link.
9.4. The user must indemnify the Center, its employees, its managers, or anyone on its behalf for any damage, loss, loss of profit, payment, or expense caused to them—including attorney’s fees and legal expenses—due to the violation of the Terms of Use. Additionally, the user shall indemnify the Center, its employees, its managers, or anyone on its behalf for any claim, suit, and/or demand raised against them by any third party as a result of content provided by them for publication on the Website and as a result of links they performed to the Website.
10. Changes to the Website, Malfunctions, and Cessation of Service
10.1. Without derogating from the above, the Center may change from time to time the structure of the Website, and/or the appearance and/or design of the Website, the scope and availability of the services on the Website, and shall be entitled to charge payment for such or other content and services—according to its decision. Furthermore, the Center shall be entitled to change any other aspect involved in the Website—all without the need to provide prior notice.
10.2. Such changes will be performed, inter alia, considering the dynamic nature of the internet and the technological and other changes occurring therein. By their nature, changes of this type may involve malfunctions and/or initially cause inconvenience, etc. Website users shall have no claim, suit, and/or demand against the Center regarding the performance of such changes and/or malfunctions that occur alongside their performance.
10.3. The Center does not guarantee that the Website services, including the ticket ordering services on the Website, will not be disrupted, will be provided regularly or without interruptions, will take place securely and without errors, and will be immune from unauthorized access to the Center’s computers or from damages, breakdowns, malfunctions, or failures—all in hardware, software, communication lines and systems, at the Center or at any of its suppliers.
11. Intellectual Property
11.1. All content appearing on the Website, including texts, images, graphic files, data, audio files, video files, and any other content appearing on the Website, are protected in accordance with copyright and intellectual property laws. It is clarified that all copyright and intellectual property rights are owned by the Center only, or owned by a third party that has permitted the Center to make legal use of this content.
11.2. One may not copy, distribute, publicly display, publicly perform, transmit to the public, change, process, create derivative works, sell or rent any part of the above, whether directly or through or in cooperation with a third party, in any way or means, whether electronic, mechanical, optical, photography or recording means, or in any other way and means, without receiving prior written consent from the Center or from the other rights holders, as applicable, and subject to the terms of consent (to the extent given) and according to any law.
11.3. If and to the extent such consent was given, one must refrain from removing, deleting, or disrupting any notice or sign regarding intellectual property rights, for example—the copyright symbol ©, or trademark symbol ®, accompanying the content that will be used.
11.4. The trademarks, photographs, images, content, and advertisements of the entities with which the Center cooperates are the property of these entities only. They too may not be used without the prior written consent of each entity (as applicable).
11.5. Without derogating from the generality of the above, it is hereby clarified that in the event of a violation of any of the provisions stated in this Section 11 above, the violating user will be required to indemnify the Center in the manner described in Section 9.4 above.
12. Jurisdiction
12.1. These Regulations and Terms of Use shall be governed exclusively by the laws of the State of Israel; however, the rules of conflict of laws stipulated therein shall not apply.
12.2. The courts in the city of Tel Aviv-Jaffa shall have exclusive jurisdiction in any matter arising from and/or related to these Regulations and Terms of Use.
13. Privacy Policy
13.1. The Center respects the privacy of Website users. The current Privacy Policy of the Website is available at all times on the website (at this link) and constitutes an integral part of the provisions of these Regulations.
13.2. Since the Privacy Policy may change from time to time, it is recommended to return and review the Privacy Policy document from time to time.
